2. These terms

These terms apply when a consumer purchases goods or services from us through happyelectronics.co.uk. A consumer is an individual acting mainly outside their trade, business, craft or profession. If you are buying for a business, please contact us because different terms may apply.

Please read these terms before ordering and save or print a copy. Nothing in these terms limits rights that cannot lawfully be excluded, including your rights under the Consumer Rights Act 2015 and the Consumer Contracts Regulations 2013.

3. Products and website information

We take reasonable care to describe products accurately. Images are illustrative and colours, dimensions and finishes may vary slightly due to displays, manufacturing tolerances or product updates. Please check the product description, room-size guidance, electrical requirements, dimensions, ventilation or exhaust requirements and included accessories before ordering.

Any capacity, energy-use, cooling-performance or noise figures are manufacturer specifications or test results under stated conditions. Actual performance may vary according to room size, insulation, heat load, installation, ambient temperature and use.

Products are subject to availability. We may update specifications or withdraw products, but changes will not materially reduce a product already ordered without your agreement.

4. Orders and formation of the contract

  1. Your order is an offer to buy the items in your basket.
  2. You can review and correct errors before selecting the button that confirms your obligation to pay.
  3. Our automated acknowledgement confirms receipt but does not necessarily mean we have accepted the order.
  4. A binding contract is formed when we send an order-acceptance or dispatch confirmation, whichever occurs first.

We may decline or cancel an order before dispatch if a product is unavailable, payment is not authorised, the price or description contains an obvious error, delivery is not possible, fraud is suspected, or purchase limits apply. If payment has been taken, we will refund it.

5. Prices and payment

Prices are shown in pounds sterling and include VAT at the applicable rate. Delivery and optional installation charges are displayed before you submit the order. You must use a payment method you are authorised to use.

Payment is processed by Stripe. We do not normally store complete payment-card details. If an obvious pricing error occurs and we have not yet accepted the order, we may cancel it or invite you to purchase at the correct price.

6. Delivery, ownership and risk

We currently deliver to all United Kingdom. Estimated times are shown during checkout. Unless a different time is agreed, we will deliver without undue delay and normally within 30 days after the contract is formed.

You must provide an accurate, accessible delivery address. Additional charges may apply to a rearranged delivery where nobody is available, access information is incorrect, or delivery cannot safely be completed for reasons within your control.

The goods become your responsibility when delivered to you or a person you nominate. You own them once we have received payment in full. Please inspect the package promptly and tell us as soon as reasonably possible about missing items or visible transit damage; this does not reduce your statutory rights.

7. Your right to cancel an online order

14-day cancellation period: in most cases, you may cancel without giving a reason from the date the contract is made until 14 days after you, or a person nominated by you, receives the goods.

To cancel, send a clear statement to [email protected] or the postal address in section 1. You may use the model cancellation form at the end of these terms, but you do not have to. It is enough to send your cancellation before the deadline.

If an order contains multiple goods delivered on different days, the period normally ends 14 days after receipt of the last item. Legal exceptions may apply, including goods made to your specifications or clearly personalised.

Services requested during the cancellation period

If you expressly ask us to begin an installation or other service during the cancellation period and then cancel after work starts, you may have to pay a proportionate amount for work completed up to cancellation. You lose the cancellation right for a fully performed service only where you expressly requested early performance and acknowledged that the right would be lost once the service was completed.

8. Returns and refunds after cancellation

After telling us you wish to cancel, you must return the goods without undue delay and no later than 14 days. Contact us first for return instructions and, where applicable, a return authorisation.

You are responsible for the direct cost of returning unwanted goods unless we agree otherwise. Because air-conditioning units can be large or heavy. We recommend tracked, insured transport and appropriate packaging.

You may inspect goods as you would in a shop. We may reduce a refund to reflect loss in value caused by handling beyond what is necessary to establish the goods’ nature, characteristics and functioning. Do not install, alter or extensively operate a unit if you may return it as unwanted.

We will refund the product price and standard outbound delivery charge using the original payment method, normally within 14 days after we receive the returned goods or you provide evidence of sending them back, whichever is earlier. Extra cost for premium delivery is not refundable beyond the cost of our least expensive standard delivery.

9. Faulty goods and warranties

Goods must be of satisfactory quality, fit for purpose and as described. If they are not, you may have legal rights to reject them, or to receive a repair, replacement, price reduction or refund, depending on the circumstances and timing. Contact us promptly with your order number, a description of the issue and, where helpful, photos or video.

We will cover reasonable return or collection costs for goods confirmed to be faulty, damaged on delivery or incorrectly supplied. We may inspect or test a returned item before providing a remedy.

Any manufacturer’s or commercial warranty stated on a product page is additional to, and does not replace, your statutory rights. Warranty coverage may exclude fair wear and tear, accidental damage, misuse, blocked filters, inadequate ventilation, unauthorised repairs or failure to follow operating and maintenance instructions, but such exclusions do not remove statutory rights.

10. Installation, maintenance and safe use

You are responsible for checking that the product is suitable for the intended space and that the electricity supply, sockets, ventilation, exhaust route, drainage and access are appropriate. Always follow the manufacturer’s manual, safety warnings and maintenance schedule.

Any work involving fixed electrical connections, refrigerant systems or building alterations must be carried out by appropriately qualified persons and in accordance with applicable law. Unless installation is expressly included in your order, our contract is for supply of the product only.

Where we arrange installation, you must provide safe and reasonable access, disclose known hazards and obtain any landlord, freeholder or planning consent required. Additional work not included in the quotation requires your agreement and may cost extra.

11. Our responsibility to you

We are responsible for foreseeable loss and damage caused by our breach of contract or failure to use reasonable care and skill. We are not responsible for loss that was not foreseeable when the contract was formed.

We do not exclude or limit liability where doing so would be unlawful, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or your statutory consumer rights.

We supply products for domestic and private use. If you use them for commercial purposes, we are not responsible for business losses such as lost profits, revenue, contracts, data or business interruption, except where the law does not permit that exclusion.

12. Privacy, complaints and general terms

Personal information

We use personal information as described in our Privacy Policy.

Complaints

Please contact [email protected] with your order number and details. We aim to acknowledge complaints within 7 working days. If we cannot resolve a complaint, we will tell you whether an applicable alternative dispute-resolution body is available.

Events outside our reasonable control

We are not responsible for delay caused by events outside our reasonable control. We will contact you as soon as reasonably possible and take steps to minimise the effect. If there is a substantial delay, you may contact us to end the contract and receive a refund for goods or services not supplied.

Intellectual property and website use

Our website, branding, text, graphics and original content are owned by or licensed to us. You may use the website for personal shopping and information, but may not copy, resell, scrape or commercially exploit it without permission.

Other legal terms

We may transfer our rights and obligations under the contract, but this will not reduce your rights. You may transfer your rights only with our written agreement, except that a warranty may be transferable where its terms say so. Each paragraph operates separately. A delay in enforcing a right is not a waiver of that right. No person other than you and us has rights under the contract.

Governing law and courts

These terms are governed by the law of England and Wales. You may bring proceedings in the courts of the part of the UK where you live. If you live outside the UK, mandatory consumer protections and jurisdiction rules in your country may also apply.
